Criminals Regularly Jumping Bail

Judges Cautioned

New Delhi, Nov.27 (PTI)

Delhi High Court has asked judges to be vigilant following an "alarming" increase in the number of convicts going "untraceable" after being granted bail.

There is an alarming and sinister increase in instances where the routine is to file an appeal, apply and be enlarged on bail and thereafter to become "untraceable" the court said.


It is about time the courts realized the harm they are doing by granting bail at the drop of a hat.

If the bails are being granted because there is no space in jails, that should be rectified.
If necessary more jails could be made.
However, I have echoed earlier Swami Ramdeo's prescription for releasing space in jails.
Persons accused in any of the following crimes should not be granted bail:
Corruption as government servants or ministers ,murder, rape, those responsible for dowry deaths, invitro testing and aborting foetus, adulteration in food and medicines, extortion, terrorism and infiltrators from Bangladesh and Pakistan.
Releasing these scoundrels on bail only allows them to influence the witnesses either with money or threats. Being out on bail, they delay the trials under various pretexes. If they were jailed, it would be in their interest to expedite the trials.

Jumping bail is another risk in releasing them on bail.This could be prevented by the convict being asked to provide surety and security some person known to him. If the convict jumps bail, the person standing as surety should be jailed, the security should be forfeited and he should be charged for all those crimes for which the criminals was being tried. Under these circumstances, I am sure very few people will come as sureties.

This same procedure should be followed by people who come over to India with genuine visas and then overstay and disappear. They too should be asked to provide the names of persons who would stand as surety and security. In case of disappearance, the sureties should be treated as infiltrators and action taken as above.

The trials should be carried out in fast track courts and in all such cases, the death penalty should be awarded. If necessary the IPC should be changed to allow for death penalty.

We have a population of 120 crores or so.
If a few thousand criminals involved in the above crimes are hanged, it would make no difference to our population but would improve the pedigree of the balance flock.

Yes, human rights groups would create a row. But then they object to anything and everything because they don't face the terrorists bullets.

And the best part is, jails would be freed of much wanted space and society would be cleansed of filthy scum.
